IMPORTANT NOTICE:

THIS RELEASE CONTAINS A BINDING GRANT OF RIGHTS TO YOUR IMAGE, LIKENESS, AND VOICE, AND A RELEASE OF CLAIMS RELATED TO OUR USE OF THAT CONTENT, WHICH APPLY TO YOUR ATTENDANCE AT ANY BARGO EVENT. BY ENTERING, ATTENDING, OR PARTICIPATING IN A BARGO EVENT, YOU AGREE TO BE BOUND BY THIS RELEASE. PLEASE READ IT CAREFULLY.

Overview

We are BarGO LLC (“BarGO”, “we”, “us”, or “our”). This Photography, Video & Social Media Marketing Release (“Release”) governs the capture, use, and disclosure of your image, likeness, voice, and other personal attributes in connection with your entry to, attendance at, or participation in any event hosted, operated, promoted, or sponsored by BarGO, including any associated venue, party, promotion, or activity (each, an “Event”).

Acceptance Of Release

This Release is a legally binding agreement. By entering, attending, or participating in an Event, you agree to this Release. If you don’t agree with this Release, please don’t enter or attend the Event.

This Release is incorporated into, and forms a part of, our Terms and Conditions and Privacy Policy. Please review these documents prior to attending an Event. To the extent allowed by applicable law, by attending an Event and agreeing to this Release, you agree to our Terms and Conditions and Privacy Policy.

All references to “you” or “your,” as applicable, mean the person who enters, attends, or participates in an Event in any manner and, where a minor is permitted to attend an Event, the minor’s parent or legal guardian, as set forth in Section 7 below.

We reserve the right to change or update this Release from time to time at our sole discretion. Such changes will be posted here with an updated “Last Updated” date above. Your continued attendance at Events following the effective date of any changes to this Release constitutes acceptance of those changes. If you do not agree to the revised Release, you may not attend future Events.

1. Grant Of Consent

BarGO and its authorized photographers, videographers, employees, contractors, and agents may photograph, film, video record, and/or audio record (collectively, “Capture”) you at an Event. By entering, attending, or participating in an Event, you consent to such Capture and to the use of your image, likeness, name, voice, and appearance as captured in any resulting photographs, video, or audio (collectively, the “Content”), as set forth in this Release. This consent is given voluntarily as a condition of attending or participating in an Event, and we are not liable to you or to any third party for any Capture undertaken in accordance with this Release.

2. License Grant

By entering, attending, or participating in an Event, you irrevocably (except to the extent you exercise applicable rights under local data protection or privacy law) grant to BarGO a world-wide, perpetual, transferable, sub-licensable, royalty-free, non-exclusive, and unrestricted license to copy, reproduce, adapt, transmit, edit, modify, crop, retouch, publicly display, distribute, and create derivative works from, or otherwise use, the Content, in any format or medium now known or later developed, including but not limited to the following:

  • social media platforms and channels (e.g., Instagram, TikTok, Facebook, X, YouTube, Snapchat, and similar services);
  • websites, mobile applications, email marketing, and text/SMS marketing;
  • paid advertising, sponsored content, and promotional campaigns;
  • print, digital, and out-of-home marketing materials (e.g., flyers, posters, banners, signage);
  • press releases, media coverage, and press kits; and
  • internal business, archival, and portfolio purposes.

This license runs to BarGO only, and does not extend to any venue, sponsor, brand partner, or other third party, unless we separately agree in writing to share the Content with that party. You also waive your moral rights to the Content. Nothing in this Section 2 will be construed to make you an employee, partner, or agent of BarGO.

3. No Compensation

You acknowledge and agree that your attendance at an Event, and any resulting Capture and use of Content, is voluntary, and that you will not receive any payment, royalty, credit, or other compensation of any kind, whether now or in the future, for our use of the Content.

4. No Obligation To Use; No Approval Rights

We are under no obligation to use any Content depicting you, and nothing in this Release guarantees that any particular Content will be captured, selected, edited, or published. You waive, to the maximum extent permitted by applicable law, any right to inspect or approve the finished Content, or any advertising or other copy that may accompany it, before or after its use.

5. Release Of Claims

You release and forever discharge BarGO, and its officers, employees, agents, contractors, and affiliates, from any and all claims, demands, actions, or liability of any kind arising out of or relating to the Capture or use of the Content as permitted by this Release, including but not limited to any claims for defamation, invasion of privacy, infringement of moral rights, or violation of any right of publicity or personality rights, whether such claims are now known or unknown, to the maximum extent permitted by applicable law.

You waive California Civil Code Section 1542, and any statute or common law principle of similar effect in the jurisdiction of your residence, which provides that a general release does not extend to claims that the releasing party does not know or suspect to exist in their favor at the time of executing the release, and that, if known, would have materially affected their decision to grant the release.

Notwithstanding the foregoing, this release does not extend to any claim arising from our use of Content in a manner that is unlawful, defamatory, or outside the scope of the rights granted under this Release.

6. Ownership

As between you and BarGO, all Content is owned by BarGO. Nothing in this Release will be construed to transfer to you any ownership interest in the Content.

7. Age Requirements; Attendance By Minors

Age requirements vary by Event. Each Event’s applicable age policy (for example, 21+, 18+, or an all-ages Event at which minors may attend) will be posted on the Event’s ticketing page, registration flow, and/or entry signage, as applicable. By entering, attending, or participating in an Event, you represent and warrant that you meet the age requirement posted for that Event.

Where an Event permits attendance by a minor, the minor must be accompanied by a parent or legal guardian. By allowing the minor to attend, the accompanying parent or legal guardian represents and warrants that they have the authority to, and do, consent to this Release on the minor’s behalf, including but not limited to the Grant of Consent (Section 1) and the License Grant (Section 2) with respect to the minor’s image, likeness, and voice. We reserve the right, in our sole discretion, to request proof of age or documentation of guardianship at any time.

8. How This Release Is Provided

We provide notice of this Release through the following means, each of which, independently, is sufficient to bind you:

  • entry signage, posted at the point of entry to an Event, and visible before you pass through the entry point; and
  • the terms presented at the time of ticket purchase or RSVP confirmation, which you must affirmatively acknowledge before completing your purchase or registration.

Where you purchase a ticket or RSVP in advance of an Event, the notice presented at checkout governs your consent from the time of purchase. Entry signage serves as a reminder of that consent and independently establishes consent for anyone entering an Event without a pre-purchased ticket, including but not limited to walk-ins and guest-list entries.

9. Opt-Out; Requesting Removal

If you do not wish to be Captured, you may (a) identify yourself to Event photography or videography personnel and request to be excluded from Capture, where reasonably practicable, or (b) avoid any designated photo or video area where signage to that effect is posted. If Content depicting you is published and you would like to request its removal from BarGO-controlled marketing channels, you may submit a request to legal@bargoevents.com, together with a description of the Content and, if available, a link or screenshot. We will make commercially reasonable efforts to address such requests, but we do not guarantee removal of Content from third-party platforms, shares, reposts, or any archived or cached version outside of our control.

10. Term

This Release applies to Content captured at any Event and remains in effect indefinitely with respect to Content already captured, subject to Section 9 above.

11. Governing Law

This Release will be governed by the laws of the State of Illinois, without regard to its conflict of law provisions, and is incorporated by reference into, and supplements, our Terms and Conditions and Privacy Policy. All Events covered by this Release are held within the State of Illinois.

12. Acknowledgment

BY ENTERING, ATTENDING, OR PARTICIPATING IN AN EVENT, YOU ACKNOWLEDGE THAT YOU HAVE READ AND UNDERSTAND THIS RELEASE, AND THAT YOU VOLUNTARILY AGREE TO ITS TERMS.
